Earls Court Carpet Cleaning Terms and Conditions
These Terms and Conditions set out the basis on which Earls Court Carpet Cleaning provides carpet, upholstery and related cleaning services to residential and commercial customers. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below.
Client means any individual, business or organisation that requests or receives services from Earls Court Carpet Cleaning.
Services means any carpet, rug, upholstery, soft furnishing, hard floor or related cleaning services carried out by Earls Court Carpet Cleaning, including inspection, stain treatment and deodorising where applicable.
Technician means any employee, contractor or representative of Earls Court Carpet Cleaning assigned to carry out the Services.
Premises means the property or location where the Services are to be performed.
2. Scope of Services
Earls Court Carpet Cleaning provides professional cleaning services within its designated service area. The exact range of services available at any time may vary and may include carpet cleaning, rug cleaning, upholstery cleaning, stain treatment, odour treatment, and related work. The precise Services to be delivered for each booking will be agreed with the Client at the time of booking.
Any descriptions of Services in promotional material are illustrative only. The level of cleaning and the results achieved depend on the condition, age and type of the items being cleaned, as well as any pre-existing staining or damage.
3. Booking Process
Bookings for Services can be made through the channels specified by Earls Court Carpet Cleaning from time to time. When you request a booking, you confirm that you have the authority to enter into a contract for the Premises where the Services are to be carried out.
All bookings are subject to availability and are not confirmed until Earls Court Carpet Cleaning has issued a booking confirmation. The booking confirmation will set out the agreed date, time window, location, and type of Services to be provided. The Client is responsible for checking that the details in the booking confirmation are correct and for notifying Earls Court Carpet Cleaning of any discrepancies as soon as possible.
Earls Court Carpet Cleaning reserves the right to decline any booking request at its sole discretion, in particular where access, safety, parking, or the nature of the work requested makes the job unsuitable.
4. Client Responsibilities
The Client must provide safe and reasonable access to the Premises for the Technician at the agreed time. The Client is responsible for ensuring that there is adequate lighting, electricity, running water, and suitable ventilation where required for the Services to be carried out.
The Client should remove fragile, valuable or easily damaged items from the areas where work is to be performed, or clearly identify these to the Technician. The Technician may decline to move heavy or delicate furniture or items where doing so might cause damage or pose a safety risk.
The Client agrees to inform Earls Court Carpet Cleaning in advance of any known issues that may affect the provision of the Services, including but not limited to severe soiling, infestation, structural damage, or previous use of unsuitable cleaning products on the items to be cleaned.
5. Pricing and Estimates
Prices for Services may be provided as fixed quotes or as estimates based on the information supplied by the Client. Where prices are provided as estimates, the final charge may vary if the actual work, measurements, condition, or access differs from that originally described by the Client.
All prices are stated in pounds sterling and, unless otherwise stated, are inclusive of applicable taxes. Any additional charges, such as congestion or parking fees, will be notified to the Client where relevant and may be added to the final invoice.
6. Payments and Invoicing
Payment terms will be confirmed at the time of booking. Earls Court Carpet Cleaning may require payment in full on completion of the Services, or in advance, depending on the nature of the booking and the Client profile.
Accepted payment methods will be specified by Earls Court Carpet Cleaning and may include card payments, bank transfer, or other cashless methods. Cash payments may be declined at the companys discretion.
For commercial Clients or larger bookings where invoicing is agreed, invoices will be issued following completion of the Services or at agreed intervals. Unless otherwise agreed in writing, invoices are due for payment immediately upon receipt and must be paid no later than the due date shown. Earls Court Carpet Cleaning reserves the right to charge interest and administrative fees on overdue invoices in accordance with applicable law.
7. Cancellations and Rescheduling
The Client may cancel or request to reschedule a booking by contacting Earls Court Carpet Cleaning within the notice period specified at the time of booking. Where adequate notice is provided, no cancellation fee will normally apply.
If the Client cancels or seeks to reschedule a booking with less than the required notice, Earls Court Carpet Cleaning may charge a late cancellation fee, up to a reasonable proportion of the quoted price, to cover the Technicians reserved time and any costs incurred.
If the Technician arrives at the Premises at the agreed time and is unable to gain access, or if the Client is not present where required and has not provided appropriate instructions, this may be treated as a late cancellation and a fee may be charged.
Earls Court Carpet Cleaning aims to attend bookings at the agreed time but may need to amend or cancel a booking due to circumstances beyond its control, such as traffic, vehicle breakdown, staff illness, or extreme weather. In such cases, the company will inform the Client as soon as reasonably possible and offer to rearrange the appointment. Earls Court Carpet Cleaning will not be liable for any losses arising from such delays or cancellations, provided reasonable steps have been taken to notify the Client.
8. Access, Parking and Restrictions
The Client must ensure that suitable parking is available for the service vehicle as close as reasonably possible to the Premises. Any parking charges, permits or fines incurred due to incorrect information or lack of suitable parking arrangements may be chargeable to the Client.
The Client acknowledges that certain buildings or locations may have access restrictions or regulations. It is the Clients responsibility to inform Earls Court Carpet Cleaning in advance of any such restrictions and to secure any required permissions for entry and work to be carried out.
9. Service Standards and Limitations
Earls Court Carpet Cleaning will provide the Services using reasonable skill and care in accordance with industry practice. However, the Client understands and accepts that results may vary depending on the age and type of carpet or fabric, the nature of stains, and any prior damage or wear.
Stain and odour removal cannot be guaranteed. Some stains may be permanent, and some odours may be embedded beyond the reach of cleaning processes. The Technician will assess the items and will not proceed with any treatment that is considered likely to cause significant damage, but the final decision to proceed rests with the Client where potential risks have been explained.
Colour change, shrinkage or texture change may occasionally occur with certain fabrics or fibres, especially where they have not been properly maintained or have been previously exposed to unsuitable products. Earls Court Carpet Cleaning is not responsible for such changes where appropriate methods and products have been used in good faith.
10. Waste Handling and Environmental Compliance
Earls Court Carpet Cleaning conducts its services in compliance with applicable waste and environmental regulations. Any waste generated during the delivery of Services, such as used cleaning solutions, filters or packaging, will be managed and disposed of in line with relevant legal requirements.
Where the Services involve the extraction of liquids, the Technician will, where possible, dispose of wastewater using appropriate drainage, and will not deliberately discharge waste in a manner contrary to local regulations. The Client agrees to permit the use of suitable drains within the Premises for this purpose, where available.
Earls Court Carpet Cleaning does not provide bulk waste removal or disposal of furniture, carpets, underlay or similar items unless this has been expressly agreed in advance as a separate service. Where such a service is agreed, it will be subject to additional charges and compliance with relevant waste carrier and disposal regulations.
11. Health and Safety
The safety of Clients, occupants and Technicians is of primary importance. The Technician will carry out a basic on-site risk assessment and may refuse to provide or continue Services where an unacceptable risk is identified, including severe infestations, structural hazards, aggressive behaviour, or unsafe working conditions.
Certain cleaning products and equipment require restricted access during and after treatment. The Client is responsible for ensuring that children, pets and vulnerable persons are kept away from the work area and from any equipment or products used, for the duration of the work and for any advised period afterwards.
12. Damage, Liability and Insurance
Earls Court Carpet Cleaning maintains appropriate insurance cover for its operations. If the Technician causes accidental damage to the Clients property while providing the Services, the Client must inform the company as soon as reasonably possible and, in any event, within a reasonable time after discovery of the damage.
The liability of Earls Court Carpet Cleaning for any loss or damage arising out of or in connection with the Services shall, to the fullest extent permitted by law, be limited to the lower of the cost of repairing the damage or the replacement value of the affected item, and in any case shall not exceed the amount paid or payable for the specific Services giving rise to the claim.
Earls Court Carpet Cleaning is not liable for any loss or damage resulting from pre-existing defects, wear and tear, inherent faults, or where the Client has failed to disclose relevant information about the condition of carpets, rugs, upholstery or other items to be cleaned.
Earls Court Carpet Cleaning will not be liable for any indirect or consequential losses, including loss of profit, loss of business, or loss of opportunity, whether arising in contract, tort or otherwise, except where such liability cannot be excluded under applicable law.
13. Complaints and Claims
If the Client is dissatisfied with any aspect of the Services, they should raise the issue with the Technician on site where possible, so that an immediate attempt can be made to address the concern. If this is not possible, the Client should contact Earls Court Carpet Cleaning within a reasonable time after the Services have been completed, providing details of the issue.
Earls Court Carpet Cleaning will investigate any complaint and may, at its discretion, arrange a return visit to rectify issues where this is feasible. The companys ability to address concerns may be limited where significant time has passed since the Services were provided or where further third party work has been carried out in the meantime.
14. Personal Data and Confidentiality
Earls Court Carpet Cleaning will collect and use personal data from Clients only as necessary for the provision and administration of the Services, in accordance with applicable data protection laws. Client information will be handled securely and will not be shared with third parties except where required to deliver the Services, administer the business, or comply with legal obligations.
15. Variations to Terms
Earls Court Carpet Cleaning may amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to that specific booking. Updated Terms and Conditions may be made available to Clients on request.
16. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
17. Severability
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted. Any such modification or deletion shall not affect the validity and enforceability of the remaining provisions.
18. Entire Agreement
These Terms and Conditions, together with any written confirmation of booking, constitute the entire agreement between Earls Court Carpet Cleaning and the Client in relation to the Services and supersede any prior discussions, correspondence, or representations regarding their subject matter. No variation of these Terms and Conditions shall be effective unless agreed in writing by Earls Court Carpet Cleaning.
